Constitution of Livonia
Constitution of the Empire of Livonia as adopted on the Fourth of October in the Year of our Lord Two-thousand and Twelve

Article One: Emperor

  1. The head of state of the Empire of Livonia shall be the Emperor
  2. The Emperor must be a member of the Most Ancient and Most Noble House of Peterson
  3. Succession will be based on male-preference primogeniture
  4. The Emperor will be vested with the power to issue Imperial Decrees that shall hold the full weight of law.
  5. An Imperial Decree may veto any act of the House of Representatives.
  6. The Emperor will be vested with the power to appoint the Imperial Council, Supreme Court, and High Council of the Imperial Defence Force with the advice and consent of the House of Representatives.
  7. The Emperor will be vested with the power to make all appointments to bodies other than the Imperial Council with the advice of the Imperial Council.
  8. The Emperor will be the Commander-in-Chief of the Imperial Defence Force and all its branches.
  9. The Emperor will have the power to award honorific and noble titles.
  10. The Emperor will receive ambassadors to the Empire of Livonia.
  11. The Emperor will be responsible for representing Livonia in foreign nations.
  12. The Emperor will be vested with the power to incorporate new territories, colonies, departments, and any other constituent into the Empire of Livonia.
  13. The Emperor will have the power to delegate these powers as they see fit but all the aforementioned powers will forever remain officially in the domain of the Imperial Crown.

Article Two: Imperial Council

  1. The Imperial Council will be the primary executive body in the Empire of Livonia.
  2. The Imperial Council will be comprised of the heads of the individual governmental ministries.
  3. The Imperial Council will be appointed by the Emperor with the advice and consent of the House of Representatives.
  4. The Imperial Council will be presided over by the Prime Minister who shall be considered the official head of government of the Empire of Livonia.
  5. The Imperial Council will be responsible for advising the Emperor on all matters of importance.
  6. Through the various ministries, the Imperial Council will be responsible for the day-to-day management of the Empire of Livonia.

Article Three: House of Representatives

  1. Legislative power will be vested in the House of Representatives.
  2. The House of Representatives will be elected by and from among the citizens of the Empire of Livonia.
  3. The House of Representatives shall have three representatives for each territory of the Empire.
  4. Representatives will be elected by the citizens of each territory to represent their territory in the House of Representatives.
  5. Each territory will be permitted to determine how it will select its own Representatives so long as the method selected is democratic in nature.
  6. Representatives will serve for a term of six months
  7. The House of Representatives will pass a law with a plurality of all Representatives
  8. The House of Representatives will approve appointments to the Imperial Council, the Supreme Court, and the High Council of the Imperial Defence Force with a simple majority of all Representatives.
  9. The House of Representatives will have the power to veto Imperial Decrees with a two-thirds majority of all Representatives.
  10. The House of Representatives may overrules an Imperial veto with a two-thirds majority of all Representatives.
  11. The House of Representatives will approve amendments to this Constitution with a two-thirds majority of all Representatives.
  12. The House of Representatives shall have to power to make any law that is necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the government of the Empire of Livonia
  13. The House of Representatives shall have the power to levy taxes to gather revenue. All taxes must be uniform throughout the Empire
  14. The House of Representatives shall have the power to borrow money in the name of the Empire of Livonia.
  15. The House of Representatives shall have the power to regulate commerce with foreign nations and among the territories
  16. The House of Representatives shall have the power to establish rules to establish citizenship
  17. The House of Representatives shall have the power to promote science and the arts
  18. The House of Representatives shall have the power to declare war with a two-thirds majority of all Representatives.
  19. The House of Representatives shall have the power to raise and maintain units for the Imperial Defence Force.
  20. The House of Representatives shall have the power to initiate a conscription drive with a simple majority of all Representatives.
  21. The House of Representatives shall have to power to make any law that is necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the government of the Empire of Livonia
  22. The House of Representatives shall not have the power to suspend the writ of habeas corpus
  23. The House of Representatives shall not have the power to pass bills of attainder of ex post facto laws
  24. The House of Representatives shall not have the power to issue titles of nobility

Article Four: Supreme Court of Livonia

  1. Judicial power will be vested in the Supreme Court of Livonia.
  2. Justices will be appointed by the Emperor with the consent of a simple majority of the House of Representatives.
  3. Justices will serve for a term of two years and may be reappointed an unlimited number of times.
  4. The Supreme Court will have the duty of ruling on all cases of civil and criminal law.
  5. The Supreme Court will have the power of judicial review over all Imperial Decrees, ministerial policies, laws of the House of Representatives, and all laws and policies of the various territories.

Article Five: Imperial Defence Force
  1. The Imperial Defence Force will be the only military force in the Empire of Livonia
  2. The Imperial Defence Force will be comprised of the Imperial Army, Imperial Navy, Imperial Air Corps, and Imperial Guard. These are the only recognized branches of the Imperial Defence Force.
  3. The Imperial Defence Force will be governed by a High Council of the Imperial Defence Force.
  4. The High Council will be comprised of the appointed heads of the various branches of the Imperial Defence Force known as High Councillors and a separately appointed Supreme High Councillor.
  5. The Supreme High Councillor will be the official head of the High Council of the Imperial Defence Force and shall be the primary military advisor to the Emperor.
  6. The Imperial Defence Force will not be permitted to raise or expend funds independently without the expressed permission of the House of Representatives and the following approval of the Emperor.
  7. The Imperial Defence Force will not be permitted to in any way seek to influence the civilian government of the Empire of Livonia through lobbying, force, or threat. Nor will the Imperial Defence Force be permitted to influence the decisions of the Emperor through force or threat.
  8. All members of the Imperial Defence Force will be required to take the following oath upon entering service: “I solemnly swear (or affirm) that I will support and defend the Constitution of Livonia against all enemies, both foreign and domestic, that I will bear true faith and allegiance to the same; and that I will obey the orders of the Emperor of Livonia and the orders of the officers appointed over me. So help me God." Mention of God may be omitted if the individual is affirming.
  9. All citizens will be required to register for conscription.
  10. Conscription will be regulated by the High Council of the Imperial Defence Force.
  11. Only the House of Representatives will have the power to initiate a conscription drive with a simple majority.

Article Six: Territories
  1. The Empire of Livonia will be comprised of a number of separate territories united under a single government.
  2. The Territories will be bound to all laws made by the central government.
  3. Territories will be permitted to determine their own internal laws and policies as they see fit so long as their laws and policies do not contradict or interfere with this Constitution or laws made by the central government.
  4. Upon admission, all territories will be required to state that they recognize the authority of this Constitution, the Emperor, and the central government over them and their territory’s residents.
  5. The Emperor alone will have the power to create or incorporate new territories.
  6. Territories will be permitted to determine their own internal system of government.
  7. Each territory will be represented by up to three representative in the House of Representatives.
  8. Each territory will be permitted to determine its own method of selecting its Representatives so long as the method is democratic in nature.
  9. Territories will not be permitted to enter into relations with foreign states without the permission of the Emperor.
  10. Territories will not be permitted to negotiate, approve, join, or sign any treaty or agreement with a foreign power without the permission of the Emperor.

Article Seven: Rights of Individuals
  1. All individuals will have the right to freedom of speech and expression.
  2. All individuals will have the right to practice their religious beliefs.
  3. The press shall be free from all censorship
  4. All individuals will have the right to assemble peacefully
  5. All individuals will have the right to petition the government for a redress of their grievances.
  6. All individuals will have the right to privacy of their residence, property, correspondence, and effects against unwarranted search and seizure. Warrants for search and seizure must be issued before a residence, or property, correspondence, or effects may be seized or searched.
  7. All individuals will have the right to a trial before an impartial judge unless they be currently enlisted in the Imperial Defence Force.
  8. No individual shall stand trial more than once for the same crime
  9. No individual may be forced to act as a witness against themself
  10. No individual may be deprived of life, liberty, or property without due process of law.
  11. No individual may have property taken from them for public use without just compensation.
  12. All individuals will have the right to confront, in a court of law, all those who accuse the individual in question of a crime and to question them and to be informed of the nature and cause of the accusation; to have compulsory process for obtaining witnesses in their favor, and to have the assistance of counsel for their defense.
  13. All individuals will be protected from any cruel and unusual punishment.
  14. Capital punishment will be prohibited in all territories of Livonia.
  15. No individual may be enslaved or held in involuntary servitude except as a punishment for crime whereof the party shall have been duly convicted.
  16. All individuals who are also citizens of Livonia shall have the right to vote. This right cannot be denied on the basis of their gender, race, age, ethnicity, nationality, religion, sexual orientation, language, employment status, social status, or economic status.
  17. All individuals will be protected from discrimination on the basis of their gender, race, age, ethnicity, nationality, religion, sexual orientation, language, employment status, social status, or economic status.
  18. The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Article Eight: National Religion
  1. Christianity will be the national religion of the Empire of Livonia, in particular the Episcopal denomination of Christianity.
  2. This church will be officially called the Episcopal Church of Livonia.
  3. The Emperor will be considered the head of the church in Livonia.
  4. The Emperor will have the sole power to appoint ministers and to determine their remuneration within the Episcopal Church of Livonia. The Emperor will not have power of appointment or remuneration of ministers outside of the Episcopal Church of Livonia.
  5. Even though there is an official religion, no individual may be forced to participate in religious behavior.
  6. Religious doctrines may not be forced upon individuals.
  7. No school will not be required to teach religious doctrines at any time as a part of their curriculum.
  8. Church-run schools will be established at the primary, secondary, and post-secondary levels for the express purpose of providing religious education.
  9. The government is not allowed to show preference to any particular religion in its policies. All policies and laws must be religion-neutral.
  10. Religious doctrine will not be the basis for the determination of scientific fact.

Article Nine: Amending this Constitution
  1. This Constitution will be considered the supreme law of the land and no law, Imperial Decree, policy of government, or policy of any territory may contradict, undermine, or interfere with any part of this Constitution.
  2. The Constitution will be amended with a two-thirds majority of all Representatives in the House of Representative, approval of the Emperor, and approval of a simple majority of all citizens of Livonia.
